COVID-Era Rehire Rules in Hospitality

Read the update below, but note that, as of October 3, 2025, the rehire rights have been extended again!
This means that, rather than expiring on December 31, 2025, these rights will extend until January 1, 2027.

What Stays the Same:
- The law still prohibits a covered employer from refusing to employ, terminating, reducing compensation, or taking other adverse action against a laid-off employee for seeking to enforce their rights under these provisions.
- Reinstated employees may still have certain benefits available to them, like paid sick leave, based on previous service to the same employer.
Next Steps for Employers:
- If you’re in the hospitality industry and you’ve laid off workers since March 4, 2020, contact your attorney to determine if you’re considered a “covered employer.”
- If you’re not in the hospitality industry, you can disregard this change.
